End User License Agreement (EULA)

1. Parties

This End User License Agreement (“Agreement”) is a legal agreement between you (“End User”) and Devidee B.V., registered at Kelvinstraat 34, 6601 HE Wijchen, the Netherlands (“Devidee”).

By installing, downloading, or using this application, you confirm that you have read and agree to be bound by this Agreement. If you do not agree, do not install or use the application.

2. License Grant

2.1 Devidee grants you a personal, non-exclusive, non-transferable, revocable license to install and use the application on devices you own or control, solely for your personal or internal business purposes in accordance with this Agreement.

2.2 You may not:

  • sell, rent, lease, or sublicense the application to any third party;
  • copy the application beyond what is reasonably necessary for normal use;
  • reverse engineer, decompile, or attempt to extract the source code, except where expressly permitted by law;
  • modify, translate, or create derivative works based on the application;
  • use the application for commercial resale or distribution without prior written consent from Devidee.

3. Ownership

3.1 The application and all associated intellectual property rights remain the sole property of Devidee. This Agreement grants you a right to use the application only, not any ownership interest.

3.2 All trademarks, logos, and brand names of Devidee may not be used without prior written permission.

4. Acceptable Use

You agree not to use the application to:

  • violate any applicable Dutch, European, or other laws or regulations;
  • send spam or unsolicited messages;
  • distribute malware, viruses, or other harmful code;
  • harass, threaten, or abuse other users;
  • infringe the privacy or intellectual property rights of third parties;
  • circumvent technical security measures;
  • scrape, harvest, or automatically extract data from the application.

5. Updates and Changes

5.1 Devidee may update the application from time to time. Updates may add, modify, or remove features.

5.2 Devidee reserves the right to modify, suspend, or discontinue the application or any part of it at any time, with or without notice.

5.3 Continued use of the application after an update constitutes acceptance of the updated version.

6. User Data and Privacy

6.1 Your use of the application is also subject to Devidee’s Privacy Policy, available at devidee.nl/privacyverklaring (Dutch) and within the application.

6.2 You are responsible for all data you enter into or share through the application. Devidee is not liable for loss or damage to your data.

7. Disclaimer and Limitation of Liability

7.1 The application is provided “as is” and “as available,” without any warranty, express or implied. Devidee does not warrant that the application will be error-free, uninterrupted, or fit for your specific purposes.

7.2 To the maximum extent permitted by applicable law, Devidee is not liable for:

  • indirect, consequential, or incidental damages, loss of profit, or data loss;
  • damages arising from your use of or inability to use the application;
  • damages caused by third parties or content shared through the application.

7.3 If Devidee is held liable for direct damages, liability is limited to the amount you paid for the application in the preceding 12 months, or 50 euros if the application is free of charge.

8. Term and Termination

8.1 This Agreement takes effect from the moment you install or first use the application and continues until terminated.

8.2 You may terminate this Agreement at any time by uninstalling the application.

8.3 Devidee may terminate this Agreement immediately if you breach any of its terms. Upon termination, your license is automatically revoked and you must uninstall the application.

8.4 Sections 3, 7, 9, and 10 survive termination of this Agreement.

9. Governing Law and Disputes

9.1 This Agreement is governed exclusively by Dutch law.

9.2 Disputes will be submitted to the competent court in the jurisdiction of Devidee’s registered office, unless the cantonal court has jurisdiction.

9.3 Parties will make reasonable efforts to resolve disputes amicably before involving courts.

10. Platform-Specific Terms

Apple App Store

If you downloaded this application from the Apple App Store:

  • Apple Inc. is not a party to this Agreement and bears no responsibility for the application or its content.
  • The license covers use on Apple-branded devices you own or control, in accordance with the App Store Usage Rules.
  • Apple has no maintenance or support obligations to you with respect to the application.
  • In the event of any failure by the application to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by applicable law, Apple has no other warranty obligation regarding the application.
  • Devidee, not Apple, is responsible for addressing any product liability claims, regulatory compliance claims, or consumer protection claims relating to the application.
  • In the event of any third-party intellectual property infringement claim relating to the application, Devidee, not Apple, is responsible for the investigation, defense, settlement, and resolution of that claim.
  • You confirm that you are not located in a country subject to a US government embargo or designated as a terrorist-supporting country, and that you are not listed on any US government prohibited or restricted parties list.
  • Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

Google Play Store

If you downloaded this application from the Google Play Store:

  • Google LLC is not a party to this Agreement.
  • Your use is also subject to the Google Play Terms of Service.

11. General

11.1 If any provision of this Agreement is found invalid or unenforceable, the remaining provisions continue in full force.

11.2 Devidee’s failure to enforce any right under this Agreement does not constitute a waiver of that right.

11.3 This Agreement constitutes the entire agreement between you and Devidee regarding your use of the application and supersedes all prior agreements relating to the same subject matter.
